What is a T Visa?

The T visa is a nonimmigrant visa specifically designed to protect victims of human trafficking. It provides:

Protection from deportation:You will be granted legal status in the U.S. and protected from removal proceedings.

Work authorization: You will be eligible to apply for a work permit and legally work in the United States.

Pathway to a green card: After three years as a T visa holder, you may be eligible to apply for a green card (lawful permanent residence).

Access to benefits and services: You may be eligible for certain public benefits and services, such as healthcare and counseling.

Who is Eligible for a T Visa?

To be eligible for a T visa, you must meet the following requirements:

Victim of a Severe Form of Trafficking: You must have been a victim of a severe form of trafficking in persons, which includes sex trafficking or labor trafficking.

Presence in the U.S. Due to Trafficking: You must be physically present in the United States, American Samoa, or the Commonwealth of the Northern Mariana Islands, or at a port of entry, as a result of being trafficked.

Cooperation with Law Enforcement (or an Exemption): You must have complied with any reasonable request for assistance in the investigation or prosecution of human trafficking, unless you were under 18 years of age or unable to cooperate due to trauma.

Suffering Extreme Hardship: You must demonstrate that you would suffer extreme hardship involving unusual and severe harm if removed from the United States.
