Are you a young undocumented immigrant who came to the United States as a child? The Deferred Action for Childhood Arrivals (DACA) program may offer you a path to temporary protection from deportation and work authorization. At Cohen Immigration Law Group, our experienced DACA lawyers can help you understand your eligibility and navigate the DACA process.
What is DACA?
DACA is an immigration policy that allows certain undocumented immigrants who entered the United States as children to receive:
Deferred Action: Temporary protection from deportation.
Work authorization: Eligibility to apply for a work permit.
Do You Need a DACA Lawyer?
The DACA program has specific eligibility requirements and a complex application process. A knowledgeable DACA lawyer can provide essential assistance by:
Assessing your eligibility: We carefully review your case to determine if you meet the DACA requirements.
Preparing your application: We help you complete the application accurately and gather all necessary supporting documents.
Representing you before USCIS: We advocate for your rights and represent you throughout the entire DACA process.
DACA Eligibility Requirements
To be eligible for DACA, you must meet several requirements, including:
Age at Entry: You must have been under the age of 16 when you entered the United States.
Continuous Residence: You must have continuously resided in the U.S. since June 15, 2007, up to the present time.
Physical Presence: You must have been physically present in the U.S. on June 15, 2012, and at the time of filing your DACA request.
Education: You must be currently in school, have graduated from high school, obtained a GED, or be an honorably discharged veteran of the U.S. Armed Forces or Coast Guard.
No Felony or Significant Misdemeanor Convictions: You must not have been convicted of a felony, a significant misdemeanor, or three or more misdemeanors, and you must not otherwise pose a threat to national security or public safety.
The DACA Application Process
The DACA application process involves:
Filing form i-821D:
You must complete and file Form I-821D, Consideration of Deferred Action for Childhood Arrivals, with U.S. Citizenship and Immigration Services (USCIS), along with supporting documentation and fees.
Biometrics Appointment:
You will attend a biometrics appointment for fingerprinting and photo capture.
USCIS Adjudication:
USCIS will review your application and evidence and make a decision on your case.
Receiving DACA:
If your application is approved, you will receive deferred action and be eligible to apply for work authorization.

I came for a second opinion on my asylum claim. Raisa told me the potential problems that could be raised by the dhs about my military service. Super helpful.

I had a phenomenal experience with Attorney Raisa Cohen. I was facing removal proceedings and didn’t know where to turn. My prior attorney was disbarred, and I went to Attorney Raisa Cohen for help. She took on my case and fought hard for me. Her courtroom skills and legal strategy were incredible. I’ll always be tremendously grateful for her help and highly recommend!

My case manager Diane Mahko and attorney Daniel Levy were great to work with. Diane, especially, was amazing. She made the process simple, provided excellent directions on what paperwork was needed, how to obtain it, and was always timely in replying to questions. If I need any assistance with Canadian immigration in the future they will be my first call.

I called Cohen Law for some advice and was genuinely impressed by how kind and helpful they were. I explained my situation and let them know I couldn’t afford to hire a lawyer, and despite that, I was given thoughtful, honest, and very helpful advice. I truly appreciated the time and care they showed me. Highly recommend them for anyone needing legal guidance!

I must say, they made easier than I expected, very fast response times, clear guidance and affordable. Victoria (citizenship) and Tereza (passport) were very professional and polite, again this was easier than obtaining documents from the USA DMV. Use Cohen if you want knowledgeable professionals! Thanks again
